What Is A Criminal Appeal?

An appeal is not a trial. In a criminal appeal, it is argued that, because of what occurred during the pretrial or trial proceedings, a criminal conviction should be reversed and the case should be returned to the trial court.

One of the most common areas for appellate litigation arises when the trial court allows evidence that violates a person’s Fourth Amendment right to be free from unlawful search and seizure. If the jury heard inadmissible evidence, any conviction that resulted should be reversed on appeal.

Other common appellate issues in criminal cases are improper jury instructions; exclusion of evidence favorable to the defendant at trial; and the prosecution’s failure to furnish evidence to the defendant that was favorable to him or her.
